Sri Lanka eyes South Asian hub with Chinese mega port

The massive terminal in Colombo is located mid-way on the lucrative east-west sea route and has facilities on a par with Singapore and Dubai.

The Colombo International Container Terminal (CICT), which is 85% owned by the state-run China Merchant Holdings International, is designed to handle mega ships - a first for Sri Lanka which is aiming to become the region's shipping hub.

The involvement of such a large Chinese company appears to conform to a pattern by Beijing after it sealed a deal in January to acquire the Pakistani port of Gwadar at a time when it is also building a US$14 million "dry port" in the Nepalese city of Larcha, near Tibet.

Chinese loans and expertise were also instrumental in the construction of a new US$450 million deep-sea port at the southern Sri Lankan city of Hambantota which opened in June 2012.

Independent shipping expert, Rohan Masakorala, says the new terminal made economic sense for China to tap in to the growing South Asian container cargo and gave Beijing a foothold along a strategic sea route.

"Terminal investments are a good business which can give a very good return," said Masakorala, a former secretary-general of the Singapore-based Asian Shippers Council.

"Through this investment, China is also securing the safety and efficiency of their main supply chain."

Masakorala, who heads the Shippers' Academy Colombo, said about half of all world sea trade passed through the east-west shipping route and a presence at a mid-way point along that gives China a commanding position.

"For China to maintain economic growth at home, they also need to go out and secure their supply routes. In that sense, coming to Colombo is a strategic commercial investment."

The Chinese investment in Sri Lanka, which is under pressure from Western powers and India over its human rights record, has raised fears in New Delhi about Beijing's influence in the neighbourhood.

But Priyath Bandu Wickrama, chairman of the state-run Sri Lanka Ports Authority (SLPA), insisted that India had nothing to fear from the new Colombo port and could in fact be a major beneficiary.

"We will not allow any military base at our ports nor will we allow them to be used for any strategic military purpose by anyone," Wickrama said.

Wickrama said shippers in India could save up to four days by routing their cargo through Sri Lanka rather than using Singapore or Dubai.

"Earlier, Indians along the east coast had to send their cargo to Singapore if they wanted to catch a mega ship going West. Now these mega ships will be going through Colombo and picking up Indian cargo," he told AFP.

"That saves time and a lot of money."

The two major ports of south India, the Port of Cochin and the Port of Tuticorin, are too shallow for mega vessels such as the world's largest container ship, the MV Maersk Mc-Kinney Moller.

Saliya Senanayake from the London-based Chartered Institute of Logistics and Transport says that "India is about five to six years behind Sri Lanka when it comes to port infrastructure".

Sri Lanka has been an important stop in the ancient Silk Sea Route and today hundreds of ships pass its southern coast daily while plying the world's busiest international shipping lane.

With a capacity of over 18,000 containers, the MV Maersk Mc-Kinney Moller, which was commissioned about two weeks ago is expected to make up a fleet of 20 mega ships in the next two years plying the East-West route.

The SLPA is pouring millions of dollars into infrastructure around the island and says it is on course to increase container handling capacity by 1.6 million containers to 6.4 million by April.

It hopes to have a container capacity of 10 million by 2020, while revenue is forecast to triple to one billion dollars by 2020.

Hambantota, which is just 12 kilometres away from the East-West sea lane, is being promoted as a key service centre and industrial port where large ships can re-fuel or take on fresh food.

In April, Colombo's port is due to open another mega terminal just next to the Chinese-managed CICT. The new addition will initially be able to handle about 800,000 containers a year, according to the SLPA.

Professor Tsz Leung Yip, head of the International Centre for Maritime Studies at Hong Kong Polytechnic University, said Chinese expertise coupled with Colombo's strategic location would make Sri Lanka a key stop-over for international carriers who want to avoid the threat posed by Somali pirates operating off the Gulf of Aden.

"In the presence of Somalia pirates, it is safer for ships (from the Far East to Europe) to stop over at Sri Lanka and head to Cape of Good Hope, without calling at Dubai port," he told AFP. - AFP, August 4, 2013.

Sen. David Vitter, R-La., shouldn't be surprised if he's not invited to the next party by some of his congressional colleagues. One week after he pushed to amend a transportation and housing bill with language barring automatic congressional pay increases, he's decrying a decision by the Obama administration to continue to allow members and staff to get federal subsidies for their health care, just as other federal employees do.

There had been questions about that ever since congressional Democrats bowed to Republican pressure, and agreed that congressional members and staff would, beginning January 1, 2014, get their health insurance from exchanges under the Affordable Care Act. The exchanges are being set up to help people choose private insurance coverage, and qualify for subsidies if their incomes meet the criteria.

But until last week, it wasn't clear how that language would be interpreted for members of Congress and their staffs. On Thursday, the administration revealed that their interpretation is that members and staff members must buy coverage from the exchanges, but are ?still eligible for the normal federal contributions for their health insurance.

"This is exactly why America rightly hates Washington. ObamaCare's a train wreck, even for Congress," Vitter said. "So it gets fixed - for Congress only. What the flip about fixing it for America?"

"And this behind-closed-doors deal, announced right after Congress is safely away from the crime scene on break, was fully supported by establishment Republicans. When it comes to protecting their own, they find a way to work just beautifully with the Democrats." Take that Mitch McConnell.

Cassidy's new flood insurance bill

Rep. Bill Cassidy, R-Baton Rouge, has introduced legislation designed he says to prevent big spikes in flood insurance premiums for Louisiana residents.

Under his bill, sections of a 2012 flood insurance law allowing sharp increases would be put on hold until FEMA adopts a flood mapping procedure that is fully vetted by local stakeholders and community leaders.

The bill also instructs FEMA to use a circular wind model where appropriate for maps, instead of a one-dimensional still water elevation system. Cassidy said that system of assessing flood risk isn't appropriate for coastal areas.

He would also return to criteria in effect before the 2012 flood insurance bill that allowed for a phase-out of subsidized flood insurance premiums when homeowners makes an improvement equal to 50 percent or more of the cost of the home. The 2012 flood insurance law lowered that threshold to 30 percent, which Cassidy contends is too low.

The bill is in addition to legislation, introduced by Cassidy and other Louisiana House members, which would delay some of the increases resulting from the 2012 flood insurance law until Sept. 30, 2014. That measure was approved as part of a House-passed homeland security bill. Sen. Mary Landrieu, D-La., who Cassidy is challenging in the 2014 Senate race, has added similar language to a Senate homeland security spending bill. Landrieu is chair of the Senate Homeland Security Appropriations Subcommittee.

Landrieu also has a stand-alone bill to block big premium increases.

No need to pay back that loan

Some Louisiana governmental entities got good news this week -- federal forgiveness of some disaster loans from hurricanes Katrina and Rita. The forgiveness was made possible by legislation Sen. Mary Landrieu, D-La, helped pass after she complained federal criteria for loan forgiveness didn't reflect the fiscal problems faced by Louisiana governmental entities. Many were without much of their tax base for months after the hurricanes.

Here are the loan amounts forgiven by FEMA: New Orleans Sewerage and Water Board, $25.1 million; Orleans Levee district, $3.9 million; Slidell, $2 million; New Orleans Communications district, $1.3 million; New Orleans Regional Transit Authority, $896,756; and Jean Lafitte, $43,652.

Landrieu, Hoeven and pipeline economics

Sens. Mary Landrieu, D-La., joined North Dakota Republican Sen. John Hoeven Wednesday in offering a sense of Congress resolution that construction of the Keystone XL Pipeline is in the nation's national interest. "We have studied this project for long enough," Landrieu said. "We know its tremendous economic benefits and the critical role it will have for our nation's energy security. With Nebraska now on board, every state involved has realized this project is a job creator with minimal effects on the environment."

The decision rests with President Barack Obama.

The president recently told the New York Times that job estimates for the project, once pegged at 100,000, are grossly inflated. "My hope would be that any reporter who is looking at the facts would take the time to confirm that the most realistic estimates are this might create maybe 2,000 jobs during the construction of the pipeline -- which might take a year or two -- and then after that we're talking about somewhere between 50 and 100 jobs in an economy of 150 million working people," the president said.

The Washington Post did a fact check on the president's statement and concluded a more realistic estimate would be that 10,400 construction workers would get jobs for just under a half a year. On an annual basis, it said, the number would be 3,900.

Congress eases airport security ordeal for wounded soldiers

Rep. Cedric Richmond, D-New Orleans, said he is pleased the House has passed a bill that would ease airport security requirements for wounded and severely disabled service members and veterans. Richmond is an original co-sponsor of the bill.

He said "the bill will make a difference in the lives of our wounded heroes." Richmond continued: "This country has a duty to honor all veterans, especially those who are wounded and disabled. Once President Obama signs this bill into law, TSA will put in place expedited screening procedures for wounded warriors and severely injured veterans to ensure that those who sacrificed so much for their country are treated with respect and dignity while traveling."

We all want to save money. However, there are ways to save money that are frowned upon at best or walk legal grey areas at worst.

Chances are that all of us do something that someone else might consider unethical: use an open wireless network while we're out, take a penny and never leave a penny, etc. Where is the line drawn, though? As finance blog Get Rich Slowly points out, we all have one, but we don't always agree:

James Cameron Announces Three Avatar Sequels

Yesterday we got a bit of an update on the long-promised sequels to writer/director James Cameron?s 2009 film Avatar, but it turns out there?s much more to the story.? Cameron has been working on two follow-up films to the sci-fi pic over the last four years, with an eye towards filming both Avatar 2 and 3 at the same time and then releasing the sequels a year apart.? While last we heard Cameron was holed up in New Zealand finalizing the scripts for the sequels, news broke yesterday that Terminator: The Sarah Connor Chronicles creator Josh Friedman had been enlisted to pitch in on the screenplay for Avatar 2.? It just so happens that this was only one third of the story, as Fox announced today that Cameron has actually enlisted the help of four screenwriters to collaborate with him on the screenplays for not only Avatar 2 and 3, but also Avatar 4, with the first sequel poised to hit theaters (finally) in December 2016.? avatar-4-sequelFox announced today that not only will Cameron now film three Avatar sequels simultaneously, but he has hired screenwriters Josh Friedman (War of the Worlds), Rick Jaffa & Amanda Silver (Rise of the Planet of the Apes), and Shane Salerno (Savages) to collaborate with him on the screenplays in order to ?help bring his growing Avatar universe to life and to expedite the process.?? This is a major development with regards to the proposed Avatar follow-ups, and Fox notes that Avatar 2 will be released in December 2016, Avatar 3 will hit theaters in December 2017, and Avatar 4 will follow a year later.? Yes indeed, a trio of Avatar films are heading our way beginning in just a few short years.

This isn?t the first time we?ve heard word about?Avatar 4, as Cameron previously teased the the potential fourth film would be a prequel that explores the colonization process of Pandora. ?Whether that?s still the plan is unknown, but we now know that Fox is guaranteed to make a shitload of money with three sequels officially in the pipeline.

And to help me continue to expand this universe, I?m pleased to bring aboard Amanda, Rick, Shane and Josh ? all writers I?ve long admired -? to join me in completing the films screenplays.?

It?s not specifically stated in the press release, but one assumes that Friedman, Jaffa & Silver, and Salerno will each be assigned a specific sequel on which to collaborate.? Jaffa & Silver most recently penned the script for the sequel Dawn of the Planet of the Apes and also wrote the upcoming Jurassic Park IV.? As for Salerno, his directorial debut hits theaters later this year by way of the documentary Salinger.

avatar-3-sequelsCameron hasn?t shared a screenplay credit on any of his directorial features since 1994?s True Lies, so it?s certainly telling that he has opened up the Avatar world to include four more voices.? Given that Avatar is the highest grossing movie of all time with a worldwide total of $2.7 billion, Fox has been eager to get the Avatar sequels off the ground for some time now.? Bringing in some screenwriting help to get these things moving might just be the momentum Cameron needs in order to finally get the follow-ups in front of cameras.? Whether three additional Avatar films is entirely necessary, however, is another question altogether.? Hopefully Cameron makes the extensive trek back into Pandora worthwhile, since these will likely tie him up from working on any other films until 2018 at the?absolute earliest?though he has said previously that he only wants to make Avatar movies from here on out.

Those who believe weddings to be exorbitant, empty spectacles have a fair-weather friend in writer-director Victor Quinaz, whose inventive debut, Breakup at a Wedding, attempts an aloof, smirking pose but surrenders to sentimentality in the end. The setup is rom com meets reality TV: Over 28-some hours, a cynical wedding videographer (Quinaz) narrates and records the disintegrating nuptials of aspiring yuppies Alison (Alison Fyhrie) and Phil (Philip Quinaz). The resulting mockumentary is suitably ugly, with the jerky rhythms, awkward close-ups, and palm-rubbing schadenfreude so common to TLC programming. Thankfully, no Bridezillas abound; instead, the pair believably break up during the rehearsal dinner, with the bride-to-be confessing she's just been going through the motions in their relationship. But Alison and Phil are loath to let their expenses be for naught, so they hatch a scheme to throw the wedding without ever signing the marriage license, leaving their friends and family none the wiser. This darkly funny premise leads to an intermittently amusing middle section where the couple's charade is overshadowed by low-stakes cringe comedy involving eccentric guests. Though Phil's an oblivious boor?early in the film, he explains he loves his future wife because "she's got really great posture, which is really awesome considering how chest-heavy she is"?he's touched enough by Alison's surprise present, a four-foot-long iPhone cake, to try to win her back. Quinaz shot the film days before his own wedding, and perhaps that explains Breakup's soft, squishy heart: It can't help but melt.

Vardon Golf Club is open for business

A very distinctive sound the crack of the driver striking flush against a golf ball once again can be heard through the trees and across the water at old Minot Country Club.

Renamed, reseeded and reopened, the Vardon Golf Club is ready for public use. After a lengthy hiatus forced by flood damage, the course opened for play Saturday.

The scenic layout was on the front line of the disastrous 2011 flood. Dikes protecting the facility were topped or torn apart by the rampaging Souris River. Deep floodwater inundated the course for so long that it killed grass on tees, fairways and greens.

When the water receded, it left behind a heavy layer of silt covering much of the course. The flood's current wreaked havoc on sand traps, too. Repair seemed improbable, too distant to comprehend.

What was once a picturesque mixture of brilliant green hues had been turned to pale gray. Hundreds of evergreens, trees sensitive to too much water, began to turn brown and die. The signature clubhouse, where golfers gathered to discuss shots made and missed and holiday buffets attracted numerous customers, was mangled so badly that it had to be torn down. The swimming pool was damaged beyond repair.

Facing a seemingly impossible task of rebuilding, the Minot Country Club sold the grounds to a group of Minot investors who are passionate about golf and the course they long enjoyed. Months of hard work followed. Remarkably, the golf course that has been part of Minot since 1929, is hosting golfers once again.

"The history of the course is one thing that appealed to us," said John Zimmerman, co-owner. "It has 85 years of history in Minot and still has ties to a lot of the old founders. We kind of look at this as a privilege to put this back together. We think this is going to be a real asset to the community. We are open to the public."

A familiar face at the Vardon Club is Todd Lee, long-time professional who served the old Minot Country Club. Lee has been busy helping oversee renovation projects at the new course, including the restoration and restocking of the Pro Shop, but he is most impressed with the condition of the renovated course.

"There's better conditions on tee boxes and fairways than there was pre-flood. No doubt," said Lee this past week. "I haven't seen grass like this here as long as I can remember. I think we've enhanced the layout and it's going to be a better golf course. Every time I come out here now it is amazing."

Golfers familiar with the previous Country Club will notice changes throughout the course. Some of the changes are subtle; others more obvious. A big change is the mixture of grasses on the fairways. Golf balls sit up on lush landing areas, producing an excellent lie for iron shots. A few sand traps have been added in challenging locations. The overall length of the course has also changed.

"From the back tees it will play a little over 6,600 yards," said Lee. "That's about 300 yards more than what it was before from the championship tees."

Ironically, for the time being, par at the Vardon Club is 71, not 72 as was the old layout. The difference comes from a change on the eighth hole, where a tee box has been moved up as a safety precaution, changing a par 5 to a par 4.

"I think golfers will see a very similar course, at least in elements," said Zimmerman. "The front nine is very similar with some small tweaks on a few holes. Some greens are a little bit larger. On the back nine, where it was hit harder by the flood, we made some changes on some holes. We'll let the golfers experience it. We're interested in what people think about the changes. This is a work in progress."

The contour of several greens has been changed, a process that would normally involve the shutting down of play for several months to allow grass to grow. However, with an entire course to be replanted, the opportunity and time was there to make grade adjustments.

"We know there's going to be some rough edges, but we're fine with that," explained Zimmerman. "Our focus has always been, first and foremost, on the course. We've worked hard to make sure it was ready to go. The integrity of the old course is still very much there."

Floodwater took a toll on trees throughout the course. Many succumbed to sitting in water for too many days. Some were older trees that had grown so large that, over time, golfers had to adjust their shots to avoid them. In all, 550 trees were removed from the course.

"Maybe, in a strange way, Mother Nature was doing some extreme pruning for us," said Zimmerman. "In the same way, it gives us a fresh start on the course. I think we'll see a better quality of play, speedier play as well. The chances of getting caught in a pine tree is a lot less now."

While veteran players of the previous Minot Country Club course will almost certainly notice the absence of some trees, newcomers to the layout are likely to marvel at tree-lined fairways and treed backdrops to greens. Despite the losses, thousands of trees remain throughout the course, giving it a very pleasant and protected appearance.

Even with fewer possibilities of a golf ball ending up on pine straw underneath low, overhanging limbs, the course still delivers an excellent balance of challenging shots for golfers of all skill levels. Additionally, many of the trees that were removed had begun to "choke" certain points on the course. With those trees gone, new grass is responding quickly to additional sunshine.

Although the old clubhouse was razed due to flood damage, the newer Pro Shop building fared far better. It has been completely renovated. The front portion of the building has a similar appearance to the old one, but the back portion has changed significantly. It now houses a bar and grill, complete with an outside deck.

"That gives us a gathering place for golfers to relax before and after a round of golf," said Zimmerman. "The restaurant is open to the public as well."

Bradley Manning and "hacker madness" scare tactic

US Army private Bradley Manning was convicted on 19 counts, including charges under the Espionage Act and the Computer Fraud and Abuse Act for leaking approximately 700,000 government documents to WikiLeaks.

While it was a relief that he was not convicted of the worst charge, "aiding the enemy", the verdict remains deeply troubling and could potentially result in a sentence of life in prison.

We will likely have a deeper analysis of the verdict later, but two things stand out as particularly relevant to ? and especially frightening for ? folks who love the internet and use digital tools.

First, the decision continues a trend of government prosecutions that use familiarity with digital tools and knowledge of computers as a scare tactic and a basis for obtaining grossly disproportionate and unfair punishments, strategies enabled by broad, vague laws like the CFAA and the Espionage Act. Let's call this the "hacker madness" strategy. Using it, the prosecution portrays actions taken by someone using a computer as more dangerous or scary than they actually are by highlighting the digital tools used to a nontechnical or even technophobic judge.

In the Manning case, the prosecution used Manning's use of a standard, more than 15-year-old Unix program called Wget to collect information, as if it were a dark and nefarious technique. Of course, anyone who has ever called up this utility on a Unix machine, which at this point is likely millions of ordinary Americans, knows that this program is no more scary or spectacular (and far less powerful) than a simple Google search. Yet the court apparently didn't know this and seemed swayed by it.

We've seen this trick before. In a case that we at the Electronic Frontier Foundation handled in 2009, Boston College police used the fact that our client worked on a Linux operating system with "a black screen with white font" as part of a basis for a search warrant. Luckily the Massachusetts Supreme Court tossed out the warrant after EFF got involved, but who knows what would have happened had we not been there. And happily, Oracle got a big surprise when it tried a similar trick in Oracle v. Google and discovered that the judge was a programmer who sharply called them on it.

But law enforcement keeps using this technique, likely based on a calculation that most judges aren't as technical as ordinary Americans, may even be afraid of technology, and can be swayed by the ominous use of technical jargon and techniques ? playing to media stereotypes of evil computer geniuses. Indeed the CFAA itself apparently was a response to President Ronald Reagan's fears after watching the completely fictional movie War Games.

Second, while the court did not convict on the "aiding the enemy" charge, the government's argument ? that publishing something to the general public on the internet can count as "aiding the enemy" ? has strong digital overtones. The "aiding the enemy" charge is a breathtakingly broad military charge never before used against a leaker to the press.

It is shocking that the government would even make this argument and that the judge didn't dismiss it outright. The prosecution argued that even if Manning never intended to aid the enemy, and even though the government did not need to prove the information published by WikiLeaks ever harmed the United States, the mere fact it ended up on the internet means he is guilty of a capital crime.

This argument wasn't actually confined to WikiLeaks ? the government admitted during the trial that its claims would apply equally to The New York Times or other traditional media. But the reason this argument wasn't laughed out of court, we suspect, is the digital environment. After all, Adolf Hitler certainly had access to American newspapers, as did Joseph Stalin, Fidel Castro, Mao Zedong, Ho Chi Minh, or any other past enemy of America. The court tried to dress it up a bit, noting that Manning "trained in intelligence and received training on the fact that that enemy uses the internet to collect information about the United States", as if this is something that only someone with specialised "internet training" would know.

But of course it's not. Everyone (at least everyone who regularly uses the internet) knows that the internet is used by good people and bad people all over the world and that anything published is, well, published and available to all. This is a feature of the Internet, not a bug, yet here it played into distorting the "aiding the enemy" crime out of all proportion and may have played a role in the five other counts under Espionage Act claims that he was convicted of.

Even without this claim, Manning still faces life imprisonment ? no member of the press or public interested in more transparency about how our military works (or doesn't work) should rest easy with this verdict.

Manning will appeal, of course. And in the long run, these tactics will likely stop working as more people become familiar with technologies. In the meantime, real harm to real people happens through overreaction, over-prosecution, and over-penalisation. And the harm also occurs to the public, which becomes less informed about governmental misconduct at home and abroad.

Here's hoping the military appellate court has a programmer or two on it and can see through the scare tactics and technophobia that the prosecution has been doling out. But we're not holding our breath.

London Bridge Live Arts: the merry medley returns

Chinese court rules against J&J in monopoly suit

BEIJING Health care giant Johnson & Johnson (JNJ) has become the latest global company accused of misconduct in China after a court ordered it to pay damages to a distributor in a lawsuit brought under an anti-monopoly law.

The ruling by a Shanghai court expands use of the vaguely worded, 5-year-old anti-monopoly law and raises the possibility of action against other foreign companies. It comes amid Chinese investigations of possible bribery, price-fixing and other misconduct by global suppliers of milk, pharmaceuticals and other products.

"This case is a warning to companies, including Chinese and foreign ones, that the Chinese government is increasing the intensity of anti-monopoly investigations," said Wang Xiang, a lawyer for the firm Orrick, Herrington & Sutcliffe.

Johnson & Johnson was found guilty of "vertical monopoly" for setting minimum prices its distributors could charge for surgical sutures, according to Thursday's ruling. The court said that caused the Chinese distributor to lose potential sales and awarded 530,000 yuan ($85,000) for lost profits.

A phone message left for Johnson & Johnson's spokesman in China was not returned.

There have been few court rulings so far on the law. That has fed uncertainty about how it will apply to global companies that are eager to expand in the world's second-largest economy.

Chinese regulators have cited the law in ordering changes to acquisitions or business practices. In 2009, they blocked Coca-Cola Co. from buying a Chinese fruit juice producer.

Business groups welcomed the 2008 law as a step toward clarifying operating conditions in China. Since then, they have said it is enforced more actively against foreign companies than against their Chinese rivals.

Beijing is especially sensitive to consumer prices at a time when Communist leaders face pressure to contain surging living costs.

Last month, two dairies -- Nestle SA and FrieslandCampina -- announced price cuts after authorities launched an investigation of possible price-fixing by foreign milk suppliers. They also were accused of using vertical monopolies.

Also last month, police detained four employees of GlaxoSmithKline on charges they bribed doctors to prescribe the British pharmaceutical giant's drugs.

The Johnson & Johnson ruling was the first involving a Fortune 500 company in an anti-monopoly case, according to lawyers and Chinese news reports.

The judge, Ding Wenlian, said the ruling reflected the law's intention of protecting consumers and "public interests," according to the government's Xinhua News Agency.

Johnson & Johnson was accused of improperly setting minimum sale prices to maintain its image as a premium brand, according to a court announcement. It said the company has since stopped imposing that condition on distributors.

The Chinese law says companies with a large market share must let market forces set prices. Companies with monopoly power are defined as one with 50 percent of sales in a given market or two that account for a total of two-thirds of sales.

The Johnson & Johnson ruling and price-fixing probes suggest Chinese authorities see all minimum price agreements as illegal, according to Ning Xuanfeng, a lawyer for the firm King & Wood Mallesons.

Companies that continue to use them "will be exposed to a great risk of being investigated or being sued," Ning said in an email. She said a company can be convicted of operating a "vertical monopoly" if a minimum price agreement is found to exist even if its sales are below the legal threshold for monopoly power.

Rainbow Medical Equipment & Supply Co. said it lost its contract with Johnson & Johnson in 2009 after it submitted a bid to supply sutures to a Beijing hospital at a price below the U.S. company's standard. Rainbow Medical it had worked for Johnson & Johnson for 15 years.

A Shanghai court rejected Rainbow Medical's lawsuit seeking 14 million yuan ($2.2 million). But a higher court ordered Johnson & Johnson to reimburse it for lost profits.

Foreign business groups also have expressed concern about a section of the anti-monopoly law that forbids abuse of intellectual property rights to hamper competition. Companies worry it might be used to force them to give know-how to potential Chinese rivals.

In the Coca-Cola case, regulators said its $2.5 billion bid for Huiyuan Juice Group would harm competition by giving the U.S. company too large a market share. Industry analysts said Beijing didn't want to see a successful homegrown brand fall into foreign hands.

Sprouts more than doubles in debut on Nasdaq

NEW YORK (AP) ? Shares of Sprouts Farmers Market Inc. more than doubled in their first day of trading on the Nasdaq.

The stock soared $18.74 to $36.74 in Thursday afternoon trading.

Shares of the natural and organic food store chain priced at $18 each, above the projected price range of $14 to $16 per share.

Sprouts initial public offering of 18.5 million shares includes 17.7 million shares being sold by the company and 797,785 shares being sold by certain stockholders.

The Phoenix company raised approximately $333 million in proceeds. It won't receive any proceeds from shares sold by selling stockholders.

Sprouts, founded in 2002, runs 163 stores in eight states.

The stock is trading under the "SFM" ticker symbol.

Exclusive: Pentagon's chief weapons buyer builds Japan ties as it eyes arms exports

TOKYO (Reuters) - The U.S. Defense Department's chief weapons buyer, Frank Kendall, will on Thursday meet officials in Tokyo overseeing Japan's defense contractors, his first visit with industry regulators reviewing the pacifist nation's decades-old ban on overseas arms sales.

The under secretary of defense for acquisitions, technology and logistics will meet officials at the Ministry of Economy Trade and Industry, a spokesman for the U.S. military said. He will also visit the foreign affairs and defense ministries.

The three ministries are together considering guidelines on what weapons, and to whom, Japanese defense contractors could sell arms.

Almost half-century-old export restrictions have isolated Japan's defense contractors, keeping the industry small, fractured and cost heavy.

While dual-use equipment such as cameras, that are also sold for civilian use, are exempt, such devices are rarely sold directly to armies by their Japanese makers.

The U.S. military, for example, uses Panasonic Corp's rugged laptop computers to guide drones, but buys them through a third-party vendor.

Kendall's visit to the Ministry of Economy Trade and Industry, which regulates exports, could help the U.S. Defense Department build deeper ties with industry officials who will play a key role in formulating rule changes that may allow companies such as Mitsubishi Heavy Industries, the maker of the World War Two-era Zero fighter, and Kawasaki Heavy Industries Ltd, which builds submarines, become suppliers to the United States.

"We see the possibility of joint development as a major step," Tatsuhiko Nojima, executive vice president at Mitsubishi Heavy told a news briefing in Tokyo to announce the company's results for the quarter that ended on June 30.

"This represents a big business chance."

Kendall, who was appointed by President Barack Obama in October 2011, wants to visit the ministry because it regulates Japan's defense industry, said an official at the ministry, who declined to be identified. The meet-and-greet may include discussion of the export restrictions, he said.

GOING FOR JOINT DEVELOPMENT

Japan's government on Friday published a policy paper, its latest step away from the constraints of its pacifist constitution and part of Prime Minister Shinzo Abe's review of defense posture in the face of perceived threats from China and North Korea.

In it, the government said it would "aggressively promote joint international development production with the United States, Britain and other countries".

Doing so could help it beef up its military by letting defense-equipment makers expand production and lower costs through greater scale without having to raise spending. The United States too could benefit from lower costs by widening its supply chain.

Japan's defense spending has stayed at around 1 percent of gross domestic product for decades, but rising maintenance costs cut its procurement budget by a third over the past 20 years.

Lockheed Martin Corp, which helped Japan build its F-2 fighter and will supply it with F-35s assembled locally by Mitsubishi Heavy, says it wants to include Japanese companies in its supply chain.

Raytheon Co is also interested in Japan as a supplier as it see renewed demand for its Patriot missile defense system. Mitsubishi Heavy makes them under license in Japan.

As it revamps its twin-rotor Chinook transport helicopters, Boeing Co too could view Kawasaki Heavy, which builds them for Japan's Self-Defense Forces, as a potential supplier.

The most immediate goal of arm exports guidelines, say industry sources, could be to allow an upgraded ship-based SM-3 missile to be sold to third countries beyond the United States and Japan.

Designed jointly by Raytheon and Mitsubishi Heavy, it is meant to destroy ballistic missiles as part of a defense shield Japan is deploying to counter any potential threat from missile-armed North Korea.

Don't get sunk by debt in the UAE

With personal lending on track to double this year, alarm bells should be ringing.

But it seems the lessons of the financial crisis are no longer at the forefront of consumers' minds, as personal borrowing hit more than Dh270 billion in the first five months of this year.

The problem, experts say, is a combination of consumerism, poor financial literacy, readily available high levels of credit and clever tricks played by banks to lure people into borrowing as much as they can afford, and sometimes more.

"The regulation is a bit lenient," says Sam Wani, the general manager of the mortgage adviser Independent Finance, who urges extreme caution when signing up for a credit card.

"If customers want to apply for a credit card, they can do it easily, and if they want multiple credit cards, they can get multiple credit cards. There's no credit bureau, so it's difficult for banks to know who they are lending to."

The Government is in the process of establishing Al Etihad Credit Bureau to provide data about individual debtors. It was due to start operating this month and would essentially provide to banks a credit score of borrowers to help them to balance their risk. At the moment, a customer with one credit card that is paid off every month may look low risk, but it is possible that he owes millions of dirhams on credit cards to other banks.

After the 2008 financial crash, the Government introduced rules to try to prevent another disaster on that scale. One of these, Mr Wani explains, is a credit ceiling, which is supposed to prevent banks from giving credit to clients who spend more than 50 per cent of their income servicing existing debts.

"They are supposed to be looking at all these things, mostly when it comes to mortgage lending," he says. "But this doesn't necessarily apply to the smaller debts.

"As mortgage advisers we have to make sure our clients don't get into debt. Most of our clients we talk to have two or three credit cards. We always advise them to cancel all but one.

"People usually have multiple cards because they are easily available and because of the promotions, the freebies attached to getting the credit card."

A compareit4me.com survey this month corroborated this theory and revealed that almost four people in 10 surveyed had three or more credit cards, and half of these people said the cards were almost all near their credit limits.

One of the most common pitfalls, according to the survey, was the trap of transferring debt from one card to another in an attempt to take advantage of a better rate or special promotion, then continuing to use both cards.

"There are 51 banks offering hundreds of different kinds of products," Mr Wani says. "Almost every credit card carries one promotion or another. But fundamentally it boils down to the individual. He has the choice. You can't over-regulate, because you are clamping down on choice and the free market goes away."

Using debt to reduce the balance of another debt is another common money pitfall. The compareit4me.com survey revealed that one person in five was resorting to using a credit card to make personal-loan repayments.

A sizeable 42 per cent admitted to making only the minimum payment on their credit cards each month. This is often a lot more expensive than people realise.

Taking into account compound interest, a debt balance of Dh100 on a credit card with a monthly finance charge of 3 per cent will increase to Dh142.5 by the end of the first year, and Dh203 by the end of the second, if only the minimum monthly payments are made. So 3 per cent is not 36 per cent a year, it is 42.58 per cent.

Taking out credit cards and simply multiplying the monthly rate by 12 is a common and dangerous mistake, Mr Wani says. It is not a representative figure.

In other countries, such as the UK, it is a legal requirement for any advertising of credit to include an APR, or annual percentage rate, which takes into account all charges associated with a product, in addition to the interest rate. This allows people to much more easily work out how their debt can grow.

In the UAE, however, there is no such requirement and banks much prefer to advertise very low monthly figures. It is down to the customer to push for an APR when applying for a credit card or loan.

"If you take a credit card, or you take many credit cards, you need to look at the annual interest, not the monthly. If the bank says 2 per cent, that means 24 per cent a year, but that's not including any charges or costs associated with acquiring that liability," Mr Wani says.

"If you are making a minimum payment you're paying a little bit of the principal and most of the interest. It's not the right thing to do. You can't pay off the outstanding. You must clear the balance every month. This is the only thing to do."

It is always worth checking whether the minimum payment includes only the interest, or also some of the balance.

A quick search of the internet gives a huge number of websites that will calculate an annual compound interest rate using the monthly figure offered by banks.

Despite the monumental financial crash in 2008, it seems banks are as keen as ever to encourage spending on credit. HSBC contacted some of its customers this month with a promotion to collect Air Miles when any of its credit cards are used abroad over the summer.

Spending the equivalent of Dh10,000 would earn the customer 40,000 bonus Air Miles. A bigger spend of Dh50,000 would be rewarded with 125,000 bonus Air Miles - which would buy about Dh900 worth of Sharaf DG vouchers from the Air Miles website.

Even the most financially savvy can be bamboozled by the wording in advertisements.

Earlier this month, eye-catching email adverts from the National Bank of Abu Dhabi were offering car loans at "2.49 per cent per annum*". The small print with the * revealed that the "2.49 per cent is for illustration purposes, effective interest rate is 4.72 per cent per annum calculated on reducing loan balance".

Ahmed, a 31-year-old Emirati, had a lucky escape after taking out a mortgage loan to buy an off-plan investment property in Al Raha Beach.

The father of one, who borrowed close to Dh1 million from an Islamic bank, says that although he isn't struggling to pay back the loan, he is "disappointed in the whole system".

"The way the banks operate is not good. When I took the loan they took a security cheque, so I was guaranteeing my own debt. I have a property but they take a cheque, so if it returns they can file a case with the police. This does not make sense."

Ahmed bought the one-bedroom property in the boom in 2008 hoping the rent would cover the mortgage payments of about Dh8,000 a month. Fortunately, he never missed a payment and the property is now leased out.

"I was lucky. But many, many people were not and the banks are also responsible. They do not act in a responsible way here.

"Many people do not read the terms and conditions, and financial awareness is very low. The banks do not explain things here."

His experience with the bank, which offered him no solutions when he approached them to say his property would not be ready on time, has left Ahmed wary of the entire financial system.

"The wife of a friend went for a top-up loan and when she showed her husband what the bank had offered her, he saw she couldn't afford the monthly payments. This is totally wrong. But I have heard many stories like this."

Souqalmal.com, the price-comparison site, reported in March that about three Emiratis in 10 have no savings at all. Half of western expatriates, it said, save between 10 and 30 per cent of their monthly income.

According to Ambareen Musa, chief executive of the site, although banks have become more responsible over the past few years, there is a huge gap in financial literacy, which is particularly a problem when it comes to advertising.

"Consumers need to be aware that all offers and products have terms and conditions to look out for, so ask the bank under what conditions is the offer applicable."

Customers should also pay more attention to the small print when taking on any sort of credit, she says, particularly credit-card fees on international spends, which most people are not aware of.

"Consumers need to build an understanding of how rates are calculated ? we also have to remember that advertising is always to incite you to buy, whether it's groceries, clothes or baking products, like in any other country.

"It is, however, our responsibility to educate ourselves on the different products."
